What are Intellectual Property Rights?
Products subject to intellectual property rights are divided into two groups: intellectual and artistic works, namely copyrights, and products subject to industrial property rights, primarily trademarks, patents and designs. Intellectual Property Rights refer to all material and moral rights that can be owned on a work, invention, design or brand, and other rights related to these rights. However, intellectual property is a product of thought belonging to a person or organization; the person or organization in question may choose to share it freely or control its use in certain ways.
What is Copyright?
Copyrights are the legally protected rights of the author on products that bear the characteristics of the person who created any work included in the Law on Intellectual and Artistic Works. Since the rights on intellectual and artistic works arise with the creation of the work, the registration process required for trademarks, patents and designs is not required for the birth of copyrights.
The copyrights of the author, which are protected by Article 27 of the Universal Declaration of Human Rights adopted by the United Nations General Assembly in 1948, are also a human right that must be protected. In our country, the copyrights of the author are protected by the Law on Intellectual and Artistic Works No. 5846. The Law on Intellectual and Artistic Works, which entered into force on January 1, 1952, is old in terms of the date it first entered into force, but has survived to the present day with some changes and additions.
What is a Brand?
A brand is a phrase consisting of pictures, images, letters and similar signs that symbolize a commercial product for the purpose of promoting it and distinguishing it from similar products. In addition, a brand serves to represent the entirety of the enterprise as a distinctive sign. The basic functions of a brand are to show the source, guarantee and advertising. Citizens of the Republic of Turkey and citizens of foreign countries can apply for trademark registration in accordance with international agreements.
What is a Patent?
These are monopoly rights granted to the patent owner for a limited period and place in order to prevent the invention from being produced, sold, used or imported by third parties without permission. The document showing that the use of this right belongs to the inventor is called a Patent Certificate.
A Patent Certificate prevents others from producing, using, selling, importing or exporting the patented product commercially without permission without the permission of the inventor.
What is Design?
Design is the appearance of the whole or part of the product or the ornamentation on it, such as line, shape, form, color, material or surface texture. Designer refers to the person who designs the design subject to protection.
